In fact, there is a ban on payday cash advances prohibiting businesses functioning in the territory of West Virginia to provide customers short-term payday loans according to W. Va. Code 46A-4-107 and 32A-3-1 et seq.
“(b) Merchants may not, in connection with providing check-cashing services, agree to hold checks submitted to them for deposit at a later date for the purpose of providing a loan of money and deriving profit therefrom.”
This means you cannot go to a local check cashing company to obtain a payday loan in West Virginia.
